Certain information we collect is “protected health information” (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). This Privacy Policy does not govern our use or protection of PHI. Instead, our HIPAA Notice of Privacy Practices (“HIPAA Notice”) applies to PHI and explains how we use and disclose PHI and your rights related to it.

Your use of the Services is also subject to our Terms of Service (our “Terms”), which incorporate this Privacy Policy.

This Privacy Policy is effective with respect to you as of the Effective Date listed above.

What does this Privacy Policy cover?

This Privacy Policy explains how we handle your “personal information”—information that identifies, relates to, describes, or could reasonably be linked to you. What categories of personal information do we collect?

When you visit our website, contact us, create an account, submit information about a prescription, or purchase non-prescription products from AccuMix, we may collect the following categories of personal information (to the extent it is not PHI):

  • Identifiers

Such as your name, personal email address, mailing or shipping address, personal ZIP code, phone number, driver’s license or state-issued ID, and other similar identifiers.

  • Internet or other network or device activity

Such as IP address, device identifiers, browser type, pages viewed, and general usage data.

  • General location information

Such as the approximate location of the device you use to access the Services, derived from your IP address or device settings.

  • Legally protected classifications

Such as gender or other demographic information you choose to provide.

  • Audio/voice recordings

Such as recordings of calls with our pharmacy or customer support teams, where allowed by law and with appropriate notice.

  • Other information you voluntarily provide

Any other details you choose to share with us that can be reasonably associated with you and are not PHI (for example, feedback, questions, or preferences).

PHI that we collect and use in providing pharmacy services (for example, your prescription and health information) is governed by our HIPAA Notice, not this Privacy Policy.

How, when, and why do we collect personal information about you?

We may collect personal information from you or about you from several sources:

From or on behalf of you

We collect personal information directly from you when you:

  • Visit or interact with our website or online portals;
  • Contact us by phone, email, SMS, or other channels;
  • Create, update, or use an account;
  • Submit information related to prescriptions or non-prescription orders;
  • Participate in surveys, promotions, or other programs.

If a family member, caregiver, or authorized representative uses the Services on your behalf, we may collect information about you from them.

From your use of the Services or interaction with AccuMix

When you use the Services, we may automatically collect information about your device and how you interact with us, such as:

  • IP address and general location;
  • Device and browser information;
  • Usage information about how you navigate and use our website or portals;

From our vendors and business partners

  • Providing information and content we think may be helpful to you in managing your health or pharmacy needs, including offers or features related to AccuMix, where permitted by law.

  • Operating, maintaining, and improving the Services;
  • Performing internal analytics, testing, quality control, and product development;
  • Marketing our Services, subject to applicable law and your preferences;
  • Creating aggregated, de-identified, or anonymized data that cannot reasonably be linked back to you;

For legal, compliance, and safety purposes

  • Complying with applicable laws, regulations, court orders, and other legal obligations;
  • Protecting the rights, property, safety, and security of you, AccuMix, our users, and the public;

For corporate transactions

  • Evaluating or engaging in business transactions such as mergers, acquisitions, reorganizations, financings, asset sales, or similar events involving AccuMix;

Why and how do we disclose your personal information to third parties?

We may disclose your personal information (other than PHI) for the purposes described in this Privacy Policy. We do not sell your personal information for monetary or “valuable consideration.”

We may disclose your personal information in the following circumstances:

To third-party vendors and business partners who help us provide, maintain, or market the Services; perform analytics; operate IT systems; process payments; deliver products; or provide other business support. These parties are contractually obligated to use the information only for our purposes and to protect it appropriately.

We do not share or disclose PHI except as allowed or required under HIPAA and described in our HIPAA Notice.

How do you correct and update your personal information?

You may correct or update certain personal information by:

Please describe the information you wish to update or correct and how it is currently inaccurate or incomplete. We may need to verify your identity before making changes.

We will process reasonable requests within the time frames required by applicable law.

How do we safeguard your personal information?

We use administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. These measures may include, for example:

  • Secure systems and encryption for certain data in transit and at rest;
  • Access controls and role-based permissions;
  • Firewalls and security monitoring;
  • Employee training regarding privacy and security.

However, no method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security.

Will this Privacy Policy change?

We may update this Privacy Policy from time to time. If we make material changes, we will provide appropriate notice—for example, by posting the updated Privacy Policy on our website, updating the Effective Date, and/or sending you an email or other notice if required by law.

Unless otherwise indicated, the updated Privacy Policy will become effective when posted. Your continued use of the Services after the effective date of any changes means that you accept the revised Privacy Policy.

What else do you need to know?

Internet and other electronic network activity / cookies

AccuMix and our third-party service providers use various tracking technologies (collectively, “cookies”) and browser storage mechanisms to help operate and improve the Services, including to:

  • Understand how you use and navigate the Services;
  • Improve performance and security;
  • Provide and measure advertising or marketing on unauthenticated pages, where applicable.

These technologies may include cookies, pixels, tags, scripts, local storage, and similar tools.

Most browsers allow you to control cookies through settings that let you:

  • Block or delete cookies;
  • Limit how cookies are placed or read.

If you disable certain cookies, some features or functions of the Services may not work properly.

At this time, our Services do not respond to browser “Do Not Track” signals.

Children’s privacy

Our Services are not directed to children and are not intended for use by minors without appropriate authorization. We do not knowingly collect personal information directly from children under 13 years of age.

  • If you are under 18, do not use the Services unless you are an emancipated minor or otherwise legally permitted to make your own healthcare decisions under applicable state law, and then only with appropriate guidance.
  • Parents or legal guardians may use the Services on behalf of their minor children and may provide us with their child’s information as needed for pharmacy services.

If we learn that a child under 13 has provided personal information directly to us without parental or guardian consent, we will use that information only as necessary to respond and will take steps to delete it, consistent with applicable law.

Information retention

We retain personal information for as long as reasonably necessary to:

  • Provide the Services and operate our business;
  • Comply with legal and regulatory obligations (including pharmacy record retention requirements);
  • Resolve disputes and enforce our agreements;
  • Protect our rights and our users.

Retention periods may vary depending on the type of information, who it relates to, and the purposes for which it was collected. We may also retain de-identified or aggregated information that does not reasonably identify you for longer periods.

PHI is retained and managed in accordance with HIPAA, applicable state law (including Illinois requirements), and our HIPAA Notice.

California Privacy Laws

If you are a California resident, California law (including the California Consumer Privacy Act, as amended by the California Privacy Rights Act, collectively “CCPA”) may provide you with additional rights regarding your personal information. This section applies only to personal information covered by the CCPA and does not apply to PHI, which is governed by our HIPAA Notice.

If you are an AccuMix employee or job applicant in California, there may be separate privacy disclosures available to you through AccuMix’s HR systems or job postings.

    • Prescription orders transmitted to AccuMix and related communications.

We may receive some of this information from publicly available sources, from other healthcare providers, or from third-party data providers that maintain healthcare professional directories.

  • Individuals purchasing only non-prescription products:
    • Order and delivery information (products ordered, delivery address, contact details);
    • Related communications with our customer support team.
  • Business contacts and prospective business contacts:
    • Business affiliation (company, practice, or organization);
    • Role or title;
    • Business contact information (work email, work phone, business address);
    • Information about your business needs, interest in our products or services, and communications with our team.

AccuMix does not “sell” or “share” personal information as those terms are defined under the CCPA.

You may request that we correct inaccurate personal information we maintain about you, subject to certain limitations and verification requirements.

  • Right to Limit Use of Sensitive Personal Information

To the extent we collect “sensitive personal information” as defined under CCPA, you may have the right to limit certain uses of that information. AccuMix does not use sensitive personal information for purposes that would require offering this right beyond what is already permitted or required by law.

  • Right to Opt Out of “Sale” or “Sharing”

California residents have rights related to the “sale” or “sharing” of personal information for cross-context behavioral advertising. AccuMix does not sell personal information as defined by CCPA and does not share personal information for cross-context behavioral advertising in a manner that would trigger a right to opt out. If this changes, we will update this Privacy Policy and provide an appropriate mechanism to opt out.

  • Right to Non-Discrimination

You have the right not to receive discriminatory treatment for exercising any of your CCPA rights, subject to certain permitted differences related to price or service level where reasonably related to the value of the data.
